ODMHSAS Administrative Rules (PDF Format)

The ODMHSAS is statutorily mandated to regulate all substance abuse treatment programs and related services and all domestic violence/sexual assault service programs in the state. Additionally, the Department regulates those residential care facilities and community mental health center treatment programs with which the Department contracts. The rules and regulations, found in various chapters of Title 450 of the state's Administrative Rules, must be followed by programs which are developing or providing services. Department staff members periodically review programs to determine their compliance with the rules and regulations. An unofficial copy is offered here. Notice of Proposed Rules

Notice of proposed changes and modifications to permanent rules.  Changes are intended to comply with statutory changes, clarify issues, correct errors, improve language and/or address other needs as appropriate.  Proposed rules are subject to a public hearing prior to permanent rulemaking.  ODMHSAS invites public comment and asks those affected by proposed rules to submit written information to the Department.  Instructions for submission are included within proposed rule notices. Permanent Rules

These rules are promulgated pursuant to the requirements of the Administrative Procedures Act, 75 O.S. § 250, et seq.  The purpose of these rules is to effectively implement and enforce Title 43A of the Oklahoma Statutes.  These rules supplement existing state and federal laws, and govern the formal proceedings of the ODMHSAS.
